AGREEMENT TO OUR LEGAL TERMS
Aykanush Sungulyan A PC ("we," "us," "our"), a California professional corporation doing business as RevitalEyes Optometry ("RevitalEyes Optometry"), is located at 4842 Van Nuys Boulevard, Sherman Oaks, CA 91403. Our practice operates under all required licenses and permits, including any applicable Fictitious Name (DBA) filings and permits required by the California State Board of Optometry.
We operate the website https://revitaleyesoptometry.com (the "Site"), as well as any other related products and services that refer or link to these Legal Terms (the "Legal Terms") (collectively, the "Services"). The Services provide information about our optometry practice and related eye health topics. They do not provide clinical care or create a provider-patient relationship.
You can contact us using the information provided in the CONTACT US section at the end of these Legal Terms.
These Legal Terms constitute a legally binding agreement between you and us concerning your access to and use of the Services. By accessing the Services, you acknowledge that you have read, understood, and agree to be bound by all of these Legal Terms, including the Medical Disclaimer (Section 1) and the privacy documents referenced in Section 8. IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, PLEASE DISCONTINUE USE OF THE SERVICES IMMEDIATELY.
We reserve the right to make changes to these Legal Terms at any time. We will indicate updates by changing the "Effective Date" above. Your continued use of the Services after any update constitutes your acceptance of the revised terms. It is your responsibility to review these Legal Terms periodically.
The Services are intended for users who are at least 18 years old. A parent or legal guardian may use the Services on behalf of a minor patient — for example, to request an appointment or complete intake forms. This age restriction applies to website use and self-submission features only; it does not limit who may receive optometric care at our clinic. For information about our practices regarding personal information collected from individuals under the age of 13, please refer to our Privacy Policy.
We recommend that you save or print a copy of these Legal Terms for your records.

1. OUR SERVICES & MEDICAL DISCLAIMER
PLEASE READ THIS SECTION CAREFULLY.
The Services provide general information about eye health, vision care, and the optometry services offered at RevitalEyes Optometry. All content on the Services is intended for informational and educational purposes only.
No medical advice. Nothing on the Services constitutes medical advice, diagnosis, or treatment. The content here is not a substitute for a professional eye examination or consultation with a licensed optometrist or other healthcare provider. Never disregard professional medical advice or delay seeking it based on something you read on this website.
No provider-patient relationship. Using the Services does not create a doctor-patient or provider-patient relationship between you and RevitalEyes Optometry or any of its healthcare professionals. That relationship is established only through an in-person clinical encounter or other lawful means under California law.
Emergencies. Do not use this website in an emergency. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
California scope. Our practice is licensed to provide optometric care only in California. The website may be accessed from outside California; users doing so are responsible for compliance with their local laws.
2. INTELLECTUAL PROPERTY RIGHTS
Ownership. Unless otherwise noted, all content and materials on the Services — including text, graphics, photographs, logos, images, and software (collectively, "Content") — are owned by or licensed to Aykanush Sungulyan A PC and are protected by applicable copyright, trademark, and other intellectual property laws. All rights are reserved.
Trademarks. The RevitalEyes Optometry name, logo, and related marks are trademarks or service marks of Aykanush Sungulyan A PC. You may not use them without our prior written permission.
Your license to use the site. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Services and view Content for your own non-commercial informational purposes. This license does not permit you to: (a) modify or create derivative works from the Content; (b) use the Content for any commercial purpose; (c) reproduce or publicly display Content beyond the scope of normal personal use; or (d) remove any copyright, trademark, or proprietary notices.
Copyright complaints (DMCA). If you believe Content on the Services infringes your copyright, please send a written notice to us at the address in Section 22, with the subject line "DMCA Notice." Your notice must comply with 17 U.S.C. §512 and include: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of where the allegedly infringing material appears on the Services; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act; and (f) your physical or electronic signature.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
- You are at least 18 years of age, or you are a parent or legal guardian using the Services on behalf of a minor patient and have authority to agree to these Legal Terms on that basis;
- You have the legal capacity to enter into these Legal Terms;
- Any information you submit through the Services is truthful, accurate, and complete to the best of your knowledge;
- You will not use the Services for any unlawful purpose or in a manner that violates applicable federal or California law, including HIPAA, the California Confidentiality of Medical Information Act (CMIA), CCPA/CPRA, or California State Board of Optometry regulations; and
- Your use of the Services will not violate any applicable law or regulation.
4. PROHIBITED ACTIVITIES
You may not use the Services for any purpose other than their intended use as an informational website for an optometry practice. You agree not to:
- Systematically retrieve, scrape, or compile content from the Services without our written permission;
- Submit false, misleading, or fraudulent information through any form or inquiry channel on the Services;
- Submit or transmit Protected Health Information (PHI) through unsecured or non-authorized channels on the Services — see Section 8 for guidance on which channels are appropriate for PHI;
- Interfere with or circumvent the security features of the Services;
- Upload or transmit viruses, malicious code, or any material intended to disrupt or harm the Services;
- Use any automated system — including bots, scrapers, or scripts — to access the Services without our express written permission;
- Impersonate RevitalEyes Optometry, its doctors, its staff, or any other person or entity;
- Use the Services or Content for any commercial or competitive purpose without our express written consent; or
- Violate applicable healthcare laws or regulations, including HIPAA, CMIA, or California State Board of Optometry advertising regulations under California Business and Professions Code §3070, in connection with your use of the Services.
5. SUBMITTED COMMUNICATIONS
The Services include features that allow you to contact us — for example, through appointment request forms or general inquiry submissions (collectively, "Submissions"). The Services do not host public reviews, comments, ratings, or user-generated content. Any feedback or reviews you wish to share about RevitalEyes Optometry should be submitted through third-party platforms such as Google or Yelp, subject to those platforms' own terms and guidelines.
When you send us a Submission, you represent that the information is accurate and that you are authorized to send it. Please do not include Protected Health Information in general inquiry forms or standard email — see Section 8 for the appropriate channels for clinical communications.
By submitting a message or inquiry to us, you grant us a limited license to use that communication for the purpose of responding to you and managing our practice operations. We will not use your Submission for advertising or marketing purposes without your separate consent.
We are not obligated to respond to every Submission and reserve the right to decline or disregard any Submission that violates these Legal Terms or applicable law.
6. THIRD-PARTY WEBSITES AND TOOLS
The Services may contain links to third-party websites or resources. We do not control those sites, and their inclusion does not imply our endorsement or approval. If you choose to visit a third-party website, you do so at your own risk and subject to that site's own terms and privacy policy.
Third-party patient intake and scheduling tools. We use third-party tools to facilitate appointment requests and patient intake — for example, forms hosted through Barti. These tools are operated by service providers acting as our Business Associates under HIPAA-compliant Business Associate Agreements (BAAs). Any Protected Health Information (PHI) you submit through those authorized tools is governed by our Notice of Privacy Practices and applicable healthcare law, not by the general provisions of this section. We encourage you to review the terms and privacy notices of any third-party tool before submitting personal or health-related information.
For third-party tools we have specifically selected to facilitate patient intake and scheduling — such as Barti — we have taken steps to establish appropriate contractual protections, including Business Associate Agreements where required by HIPAA. However, we are not responsible for the independent acts or omissions of those providers beyond what is addressed in those agreements. For general third-party websites linked from the Services that are not part of our care delivery workflow, we have no contractual relationship and bear no responsibility for their content, practices, or security. Questions about third-party services should be directed to the relevant provider.
7. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to monitor the Services for compliance with these Legal Terms. We may, at our discretion:
- Take appropriate action — including referral to law enforcement or relevant regulatory authorities such as the California State Board of Optometry — against any person who violates these Legal Terms or applicable law;
- Restrict or suspend access to the Services if we reasonably believe a user's activity poses a risk of harm, violates applicable healthcare regulations, or compromises the security of personal or health information; and
- Modify, remove, or disable content or features on the Services at any time for operational, legal, or regulatory reasons.
8. PRIVACY POLICY & HIPAA NOTICE OF PRIVACY PRACTICES
Because RevitalEyes Optometry is a healthcare provider, different privacy frameworks apply depending on the type of information involved and how it is collected.
Protected Health Information (PHI) — governed by our Notice of Privacy Practices. PHI includes information related to your past, present, or future physical health, the care provided to you, or payment for that care, that identifies you. Any PHI you provide through authorized clinical channels — including in-person visits, Barti-hosted intake forms, or other tools operating under a Business Associate Agreement — is governed by HIPAA and the California Confidentiality of Medical Information Act (CMIA) (Cal. Health & Safety Code §56 et seq.). Our full practices and your rights regarding PHI are described in our Notice of Privacy Practices. Please do not submit PHI through general contact forms or standard email.
Other personal information — governed by our Privacy Policy. Personal information that is not PHI — such as website analytics data, IP addresses, and general inquiry submissions — is governed by our Privacy Policy. The Privacy Policy also describes the tracking technologies we use (including Google Analytics, Meta Pixel, and Microsoft Clarity), your rights under CCPA/CPRA, and how to exercise those rights.
SMS communications. If you have provided your phone number through our patient intake process and consented to text communications, those communications are also subject to Section 19 of these Legal Terms.
Both documents are incorporated into these Legal Terms by reference. By using the Services, you acknowledge that you have read and agree to the practices described in each.
9. TERM AND TERMINATION
These Legal Terms remain in effect while you use the Services. We reserve the right to restrict or suspend your access to the Services if we determine, in our reasonable judgment, that you have violated these Legal Terms or applicable law — including healthcare regulations such as HIPAA and CMIA, California State Board of Optometry rules, or privacy laws such as CCPA/CPRA. We will pursue appropriate legal remedies for material violations.
10. MODIFICATIONS AND INTERRUPTIONS
We may modify, suspend, or discontinue the Services or any part of them at any time without notice, including to reflect changes in our practice, legal requirements, or technology. We are not liable for any loss or inconvenience caused by unavailability of the Services. Nothing in these Legal Terms obligates us to maintain the Services or provide updates.
11. GOVERNING LAW
These Legal Terms are governed by the laws of the State of California, without regard to conflict of law principles.
12. DISPUTE RESOLUTION
Scope. This section applies only to disputes arising from your use of the Services, these Legal Terms, or certain disputes arising under our website Privacy Policy. It does not apply to any dispute arising from the provision of professional optometric services, clinical care, diagnosis, treatment, billing for clinical services, or any matter governed by healthcare-specific informed consent, privacy, or professional responsibility laws.
Try to resolve it first. Before starting any formal proceeding, the party raising the dispute must send the other party a written notice describing the issue, the requested relief, and contact information for follow-up. The parties will then make a good-faith effort to resolve the matter informally for thirty (30) days after receipt of that notice.
Arbitration. If the dispute is not resolved informally, it will be decided by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is filed. This arbitration agreement is intended to be interpreted and administered consistently with the AAA Consumer Arbitration Rules and Consumer Due Process Protocol. BY AGREEING TO ARBITRATION, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL. The arbitrator may award any individual remedy that a court could award, including injunctive or declaratory relief to the extent permitted by applicable law. Filing fees and costs will be governed by the AAA Consumer Rules. Each party will bear its own attorneys' fees except where a statute or other applicable law provides otherwise. Hearings may be conducted by document submission, video, telephone, or in person. Any in-person hearing will take place in Los Angeles County, California, unless the AAA Consumer Rules or applicable law require otherwise.
Individual claims only. Disputes must be brought only on an individual basis. You may not participate as a plaintiff or class member in any class, collective, coordinated, consolidated, or representative proceeding, to the fullest extent permitted by law. If this restriction is found unenforceable as to a particular claim or remedy, that claim or remedy will be severed and heard in a court of competent jurisdiction, and any remaining claims will proceed in arbitration.
Exceptions. Either party may bring an individual action in small claims court if the claim qualifies. Either party may also seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, or data security pending completion of arbitration. If any part of this section is found unenforceable, that part will be severed and the remainder will continue in effect.
Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@revitaleyesoptometry.com within thirty (30) days after your first use of the Services following the Effective Date of these Legal Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. Your decision to opt out will apply only to you and will not affect any other part of these Legal Terms.
13. CORRECTIONS
Content on the Services may contain errors or inaccuracies. We reserve the right to correct any such errors and to update or remove content at any time without prior notice.
14. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE (INCLUDING FITNESS FOR MAKING HEALTH OR MEDICAL DECISIONS), AND NON-INFRINGEMENT.
THE CONTENT ON THE SERVICES IS FOR INFORMATIONAL PURPOSES ONLY. IT DOES NOT CONSTITUTE MEDICAL ADVICE AND IS NOT A SUBSTITUTE FOR A PROFESSIONAL IN-PERSON EXAMINATION. USE OF THE SERVICES DOES NOT CREATE A PROVIDER-PATIENT RELATIONSHIP. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL FOR DIAGNOSIS AND TREATMENT. IN AN EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT ENDORSE OR ASSUME RESPONSIBILITY FOR ANY THIRD-PARTY CONTENT, PRODUCTS, OR SERVICES LINKED FROM OR REFERENCED ON THE SERVICES.
15. LIMITATIONS OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATED HEALTHCARE PROFESSIONALS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR ANY CONTENT THEREON — INCLUDING DAMAGES FOR LOST DATA, LOST REVENUE, OR PERSONAL INJURY — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION LIMITS OUR LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE LEGAL TERMS OR YOUR USE OF THE SERVICES IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID, IF ANY, TO ACCESS THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100). BECAUSE ACCESS TO THE WEBSITE IS GENERALLY PROVIDED AT NO CHARGE, THIS CAP WILL IN MOST CASES REFLECT THE $100 FLOOR. THIS LIMITATION APPLIES SPECIFICALLY TO CLAIMS ARISING FROM THE WEBSITE AND ITS INFORMATIONAL CONTENT AND DOES NOT LIMIT LIABILITY FOR CLAIMS ARISING FROM THE PROVISION OF PROFESSIONAL OPTOMETRIC SERVICES, WHICH ARE GOVERNED BY APPLICABLE HEALTHCARE LAW AND PROFESSIONAL STANDARDS.
SOME CALIFORNIA AND FEDERAL LAWS — INCLUDING THOSE GOVERNING PROTECTED HEALTH INFORMATION UNDER HIPAA AND THE CALIFORNIA CONFIDENTIALITY OF MEDICAL INFORMATION ACT (CMIA) — DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS. WHERE THOSE LAWS APPLY, THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
16. INDEMNIFICATION
You agree to indemnify and hold harmless Aykanush Sungulyan A PC, RevitalEyes Optometry, and their respective officers, employees, agents, and healthcare professionals from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services in violation of these Legal Terms;
- Any Submission you provide through the Services that is false, misleading, made in bad faith, or in violation of these Legal Terms;
- Your violation of any applicable law, including HIPAA, CMIA, CCPA/CPRA, or California State Board of Optometry regulations; or
- Your violation of the rights of any third party, including privacy or intellectual property rights.
This indemnification does not apply to claims arising directly from the provision of professional optometric services rendered in compliance with the applicable standard of care. We reserve the right to assume control of the defense of any matter subject to indemnification at your expense, and you agree to cooperate with that defense.
17. USER DATA
PHI. Any Protected Health Information you submit through authorized channels — such as Barti-hosted intake forms — is handled in accordance with our Notice of Privacy Practices, HIPAA, and CMIA. For guidance on which channels are appropriate for PHI, see Section 8.
Other personal information. Non-PHI personal information collected through the Services is handled in accordance with our Privacy Policy, including our data retention practices described therein.
Security. We implement reasonable administrative, physical, and technical safeguards to protect information transmitted through the Services. No method of electronic transmission is completely secure. In the event of a data breach, we will provide notice as required by applicable law, including HIPAA's breach notification rules and California Civil Code §§1798.29 and 1798.82.
18. ELECTRONIC COMMUNICATIONS AND SIGNATURES
By using the Services, you consent to receive communications from us electronically — including via email or notices posted on the Services. You agree that electronic communications satisfy any legal requirement that such communications be in writing. You also agree to the use of electronic signatures and records in connection with your use of the Services.
19. SMS TEXT MESSAGING
If you provided your mobile phone number during the patient intake process and consented to text communications, RevitalEyes Optometry may send you SMS messages for the following purposes: appointment reminders and occasional practice updates such as office closures or scheduling changes. We do not send promotional or marketing text messages.
Consent and how it was collected. Your consent to receive SMS communications was obtained through the patient intake form, which includes the following disclosure: "By providing your number below, you consent to phone or text communication from your eyecare provider's office." You are not required to consent to text communications as a condition of receiving care.
HIPAA notice. Standard SMS is not a fully secure communication channel. Messages may not be encrypted and could potentially be accessed by third parties. Please do not reply to SMS messages with Protected Health Information. For secure clinical communications, please use the methods described in our Notice of Privacy Practices.
Opting out. You may opt out at any time by replying STOP to any message from us. You may receive a final confirmation message acknowledging your opt-out.
Message and data rates. Standard message and data rates from your mobile carrier may apply. RevitalEyes Optometry is not responsible for any carrier charges.

20. CALIFORNIA USERS AND RESIDENTS
Complaint assistance. If a complaint with us is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

California privacy rights (CCPA/CPRA). California residents have certain rights regarding their personal information under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). We voluntarily extend these rights to California residents regardless of whether we meet the statutory thresholds that would make CCPA/CPRA legally applicable to our practice. These rights include:
- The right to know what personal information we collect, use, and share;
- The right to delete personal information we hold about you, subject to exceptions;
- The right to correct inaccurate personal information;
- The right to opt out of the sale or sharing of personal information;
- The right to limit use of sensitive personal information; and
- The right not to be discriminated against for exercising these rights.
These rights apply to personal information that is not PHI. Rights regarding PHI are governed by HIPAA and CMIA and are described in our Notice of Privacy Practices. For instructions on how to exercise your CCPA/CPRA rights, please see our Privacy Policy.
21. MISCELLANEOUS
These Legal Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and us regarding your use of the Services.
If any provision of these Legal Terms is found to be unlawful or unenforceable, that provision will be severed, and the remaining provisions will continue in full effect.
Our failure to enforce any right or provision of these Legal Terms does not constitute a waiver of that right or provision.
We may assign our rights and obligations under these Legal Terms without restriction. You may not assign your rights under these Legal Terms without our prior written consent.
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control.
These Legal Terms are governed by California law.
